Terms of Service

HappyBelly is an online marketplace that connects buyers with independent home cooks, bakers and small food makers. HappyBelly does not cook, prepare, store, handle or sell food. Every contract for food is between the buyer and the cook. HappyBelly is not a party to it.

• You must be 18 or older to hold an account.
• Give accurate information and keep your sign-in details private.
• You are responsible for activity on your account.
• We may suspend or close accounts that break these terms, harm other users, or are used for fraud.

Placing an order is an offer to buy from the cook. The order is confirmed when the cook accepts it. Prices, cut-off times, pickup windows and delivery options are set by the cook. Buyers pay the cook for the food.

• Hold every permit, registration, licence and insurance your local law requires.
• Follow safe food handling and hygiene practice at all times.
• Describe dishes, ingredients, allergens and portion sizes accurately.
• Honour accepted orders, agreed times and agreed prices.
• Handle buyer information only to fulfil their order.
• Report and pay any taxes due on your sales.

Cooks pay HappyBelly a commission on sales made through the platform, billed monthly and shown in the cook dashboard. Buyers pay no platform fee. Statements unpaid beyond the grace period shown in the dashboard may lead to the kitchen being suspended.

Reviews may only be left by people who bought the item. Do not post false, abusive, discriminatory or unlawful content. You keep ownership of photos and text you upload and grant HappyBelly a licence to display them on the platform and in related promotion. We may remove content that breaches these terms.

• Alcohol, cannabis, tobacco, medicines, supplements with health claims, or anything requiring a licence you do not hold.
• Food you know to be unsafe, expired or mislabelled.
• Taking orders or payment off-platform to avoid commission.
• Harassment, discrimination, impersonation or scraping the site.

HappyBelly is provided "as is". We review kitchens before they go live but we do not inspect kitchens, verify licences, test food, or guarantee quality, safety, legality or accuracy of listings. We do not guarantee uninterrupted service.

To the fullest extent permitted by law, HappyBelly, Inc. is not liable for illness, injury, allergic reaction, loss or damage arising from food bought through the platform, or for any indirect or consequential loss. Where liability cannot be excluded, it is limited to the commission or fees you paid us in the three months before the claim. Nothing here limits liability that cannot lawfully be limited.

Cooks agree to indemnify HappyBelly against claims arising from the food they sell, their listings, or their failure to hold required permits.

We may update these terms; material changes will be announced on the site. You may close your account at any time. We may suspend access for breach of these terms.

These terms are governed by the laws of the District of Columbia, USA, and disputes are subject to the courts located there, unless mandatory local law where you live says otherwise.
